Terms & Conditions

The following Terms and Conditions apply to all purchases of products by you from www.midgeguard.co.uk via this website and you should read them carefully. We may vary these terms from time to time and therefore you should check them before you make a new purchase.

1. Guarantee of Quality

Midge Guard Limited guarantees that all manufacturer’s/supplier’s products meet the required standards for the purpose they were intended. The Mosquito Magnet® is also known as the Midge Magnet®.

2. Payment Options

Payment may be made by Cheque (payable to “Midge Guard Limited”), Credit or Debit Card and Paypal. Please state the payment method where requested. Click on Pay by Credit Card, Debit Card, Paypal or Cheque, in all cases, to complete the order process. Midge Guard welcomes payment by the following credit and debit cards on www.midgeguard.co.uk: Visa, MasterCard, Maestro, Visa Electron and Solo. Delivery of orders will be made within 30 days from receipt.

3. Returns Procedure

Midge Guard makes every effort to ensure orders arrive in perfect condition. However, in the unlikely event of an order not being delivered within 15 working days from the dispatch date (Saturdays, Sundays & Public Holidays not included) customers should advise Midge Guard by email – info@midgeguard.co.uk.Midge Guard will make every effort to locate the order, and if necessary, send a replacement at our expense or provide a full refund, subject to the correct delivery address having been supplied to us with the order. If an order arrives damaged in any way, customers should contact Midge Guard by email within 7 days of receipt. In this case Midge Guard will, depending upon our customers’ preference, arrange for the damaged product (Mosquito Magnet only) to be picked up and returned to our delivery point. Midge Guard will either send a replacement product or, make a refund, when we have confirmation that the damaged product has been returned.

It is the customer’s responsibility to ensure the goods safe keeping and retention of quality. If goods are returned, neither faulty or wrongly dispatched; simply returned as not required, it is then the customer’s responsibility to arrange return at their own expense.

www.midgeguard.co.uk is entitled to levy a return charge to cover the administration and   re-packaging of said items at a cost of 30% + VAT of the retail price.
If goods become faulty within the manufacturer’s period of guarantee and, the fault is not due to mishandling by the user, action will be taken to repair or replace the item in accordance with that manufacturer’s warranty. Goods to be returned after the 7 day period above or those that are not faulty, can only be done so with the agreement of www.midgeguard.co.uk who reserve the right, in all cases, to make a re-stocking charge of 30% + VAT of the retail price. This in no way affects your statutory rights

Under The Consumer Protection (Distance Selling) Regulations 2000, the consumer has a cooling-off period of 7 working days, beginning on the day after the goods are received by them. If a refund is required, this will be made within 30 days from the date of cancellation, less the cost of the return if the goods are not returned by the consumer within this period.

4. Refunds

Refunds for valid claims will be made via the same method of payment as used to place the order.  Refunds will only be considered with production of proof of purchase.

5. Delivery Methods & Times

Bugshirt deliveries within the United Kingdom will normally be sent out by first class or small parcel post depending upon the number of garments ordered; Bugshirts are usually dispatched within 3 working days. Please allow an extra working day for delivery to remote areas.

Please note that all Mosquito Magnet orders MUST be signed for on delivery. If no-one is available on the first day to accept delivery, a card will normally be left through the consignee’s letter box advising an attempt to deliver had been made. The carrier will normally telephone before making another delivery attempt. Deliveries are attempted twice (first delivery day & normally next working day), thereafter parcels may have to be collected from the local delivery depot. Midge Guard cannot be held responsible for delivery delays caused outside of their control.

6. Retention of Title

This remains with Midge Guard until the goods are paid for in full.

7. Delivery Charges

These are automatically added to or included in the cost of the order as part of the process of submitting an order.

8. Application of Value Added Tax (VAT)

VAT is included in the cost of each order, where applicable.

9. Order Confirmation

Once you have placed your order and paid by credit/debit card or Paypal, you will receive a confirmation email from Midge Guard Ltd with details of your order, including an order reference number – please quote this when contacting us.

We do accept cheques and ask that they be made out to Midge Guard Limited. When you place an order, choose the ‘pay by cheque’ option. You will receive a confirmation email from Midge Guard Ltd with details of your order, including an order reference number – please quote this when contacting us. Once we have received your cheque and payment has cleared, your order will be dispatched.

10. Confirmation of Dispatch

In the case of Mosquito Magnets, confirmation of dispatched orders will be sent by email following dispatch of the order, showing consignment tracking number, if appropriate, with date and time of dispatch. Bugshirts are normally dispatched the day after the order is received and tracked using the electronically generated order number which is emailed to the buyer upon completion of their order.

11. Invoices

Invoices are normally electronic. However, where a cheque is received and cleared, the invoice will be sent by post.

13. Data Protection

Midge Guard does not sell its database to anyone:  its customers, and information contained on customers, remains confidential to the distributors. We are committed to protecting your privacy. We will only use the information we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you (name, address, telephone numbers & email address submitted by you during the order process) for three reasons:

a. Take and fulfill customer orders
b. Administer and enhance the site and service
c. Only disclose information to third-parties for goods delivery purposes

14. Limited Warranty

The product manufacturer, American Biophysics Corp., having its principal place of business at 2240 South County Trail, East Greenwich, RI 02818 (“manufacturer”) warrants its Mosquito Magnet™ as follows:
a. Limited Warranty. The manufacturer warrants that the products sold hereunder will be free from defects in material and workmanship for a period of one (1) year from the date of purchase with proof of purchase. If the products do not conform to this limited warranty during the warranty period (as herein above specified), buyer shall notify manufacturer in writing of the claimed defects and demonstrate to manufacturer satisfaction that said defects are covered by this limited warranty. If the defects are properly reported to manufacturer within the warranty period, and the defects are of such type and nature as to be covered by this warranty, manufacturer shall, at its own expense, supply replacement products or, at manufacturer’s option, replacement parts for the defective products. Shipping and installation of the replacement products or replacement parts shall be at buyer’s expense.
b. Other Limits. THE FOREGOING IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. The manufacturer does not warrant against damages or defects arising out of improper or abnormal use of handling of the products; against defects or damages arising from improper installation (where installation is by persons other than manufacturer), against defects in products or components not manufactured by manufacturer, or against damages resulting from such non-manufacturer made products or components. Manufacturer passes on to buyer the warranty it received (if any) from the maker thereof of such non-manufacturer made products or components. This warranty also does not apply to products upon which repairs have been effected or attempted by persons other than pursuant to written authorisation by manufacturer.

c. Exclusive Obligation. THIS WARRANTY IS EXCLUSIVE. The sole and exclusive obligation of manufacturer shall be to repair or replace the defective products in the manner and for the period provided above. Manufacturer shall not have any other obligation with respect to the products or any part thereof, whether based on contract, tort, strict liability or otherwise. Under no circumstances, whether based on this Limited Warranty or otherwise, shall manufacturer be liable for incidental, special, or consequential damages. The manufacturer reserves the right to replace defective products with re-manufactured components.
d. Entire Obligation. This Limited Warranty states the entire obligation of Manufacturer with respect to the Products. If any part of this Limited Warranty is determined to be void or illegal, the remainder shall remain in full force and effect.

15. Unforeseen Circumstances

While every effort will be made to meet shoppers’ demands, cancellations or variations may be necessary and delivery delays may occur as a result of Act of God, war, strike, lockout, labour dispute, fire, flood, drought or other causes beyond the control of Midge Guard. In such circumstances Midge Guard will not be liable to pay compensation.

16. Complaints

If you have a complaint, please contact us immediately by email to info@midgeguard.co.uk. All complaints will be acknowledged normally within 3 working days.  Any complaint will be dealt with fairly, effectively and confidentially. These complaints will normally be resolved within 7 working days unless otherwise advised to the customer. These terms and conditions do not affect your consumer’s statutory rights.

17. Law

These terms and conditions shall be governed by and construed in accordance with English Law and you hereby agree to be subject to the jurisdiction of the courts of the land.
